Bicycle Accidents

Did you know that Florida ranks #1 for bicycle accidents?

This is because of people who drive and strike bike riders without looking while texting on their phones, or applying makeup at the same time they are driving.

There are two sides to this story, however. We also had biker riders who take over the road with their pack and pay no attention to red lights. In Miami-Dade County alone the local police have been giving tickets and warnings for this offense.

If you or a family member has ever been involved in a bicycle accident, be sure to move to the side of the road, if possible, for safety. Take photos of the accident, including the license plate of the car/vehicle that struck you. If a limb or body part has been severed, do not try to move the bicyclist, and try to block off the area and have traffic rerouted.

Report the accident to the local police, if deemed necessary, especially if injured. Call your insurance company and let them know the accident occurred.

Do not speak to the person who hit you, or to their insurance company or legal counsel.

We recommend that you do not accept any money until you have spoken with your own legal counsel.

If you get injured you may be compensated for:

  •  Past/future medical expenses
  •  Past and future loss of earnings
  •  Inability to work
  •  Costs to repair your personal property

You may have any of the following:

  • Loss of enjoying everyday tasks or employment
  • Pain and suffering (the need for constant pain medication)
  • Emotional distress (fear of going outside or ever riding a bike again)

If a person dies from a bicycle accident, this is an even more significant matter.

Please contact the police, legal counsel, and take photographs. There were 938 bicyclists killed in traffic-related crashes in 2020.

Bike Safety:

  •       Always wear a helmet
  •       Obey traffic laws
  •       Follow the same rules as motorists
  •       Ride single file (not in packs)
  •       Remain alert (do not text and ride)
  •       Use hand signals
  •     Wear reflector clothing or use a flashlight, especially if biking in the dark or during early morning hours.
